Terms of Service
These Terms of Service (Terms) govern your use of EyesOn. EyesOn is provided by Luke Davoli, a sole trader trading as Davoli Software, ABN 12 245 887 016, in Victoria, Australia (EyesOn, we, us or our).
By creating an account, you agree to these Terms. Our Privacy Policy explains how we handle personal information.
1. Eligibility and accounts
You must be at least 18 years old, provide accurate account information, and be legally able to enter into these Terms. You may not create an account for another person without their authority.
You are responsible for activity through your account and for keeping your sign-in method and devices secure. Contact luke@davolisoftware.com promptly if you believe someone has accessed your account without permission.
2. Using EyesOn
EyesOn is a social-accountability service that lets members create goals, record progress, share selected information, connect and interact.
You choose the audience for each goal. Related updates, measurements, photos, comments and activity may be visible to that audience. People who can view content may copy or share it outside EyesOn. Blocking someone or deleting content cannot recall copies they already made.
We may add, change, suspend or remove features. We aim to keep EyesOn available and reliable, but maintenance, faults, third-party services and product changes may affect availability or content preservation.
3. Your content
You retain ownership of content you submit to EyesOn.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, reformat, transmit and display your content as reasonably necessary to operate, secure, support and improve EyesOn, apply your audience choices and comply with law. This licence ends when the content is deleted from our active systems, except where a temporary recovery copy, safety record or legal preservation requirement applies.
You must have the rights and permissions needed to submit your content and must not infringe another person's privacy, intellectual property or other rights.
We may use rewritten, genuinely de-identified summaries of member experiences to explain or promote EyesOn. We will obtain separate permission before using your exact words or photos in marketing, or where a story cannot reasonably be de-identified.
4. Community rules
You must not use EyesOn to:
- harass, threaten, stalk, exploit or discriminate against another person;
- promote hatred, violence, self-harm or sexual exploitation;
- post graphic violence, credible threats or illegal content;
- impersonate someone or misrepresent your identity or authority;
- spam, scam, manipulate engagement or interfere with the service;
- reveal another person's private or confidential information without permission;
- infringe intellectual property or other legal rights;
- evade safety controls; or
- access accounts, systems or information without authority.
Respectful, good-faith discussion of mental health, addiction, recovery and other difficult experiences is allowed.
5. Reports and moderation
You can report supported profiles and content and block other members using the controls in EyesOn. We review reports privately and will endeavour to respond as soon as reasonably feasible.
We may remove content, restrict features, suspend an account or terminate an account where we reasonably consider it necessary for safety, security, legal compliance, or a serious or repeated breach of these Terms.
Where reasonably practicable and safe, we will notify an affected member of the action and its general reason. The member may make one review request by emailing luke@davolisoftware.com within 30 days of the notice. We will reconsider the available information and communicate an outcome as soon as reasonably feasible.
6. Not an emergency or professional service
EyesOn is a general accountability service. It is not an emergency service and does not provide medical, mental-health, legal, financial or other professional advice. It does not diagnose or treat any condition or guarantee that you will achieve a goal.
If someone is in immediate danger in Australia, call 000. Seek appropriately qualified help for professional advice or support.
You are responsible for deciding what goals to pursue, what information to share, and how to act on information or encouragement from other members. We do not endorse member content or guarantee that it is accurate, safe or lawful.
7. Third-party services and EyesOn intellectual property
EyesOn relies on third-party services for functions such as authentication, hosting, storage, notifications, support and app distribution. Their services and terms may also apply to you.
Except for member content, EyesOn and its software, branding, designs and documentation are owned by or licensed to Davoli Software. You may send us suggestions or feedback, which we may use to operate and improve EyesOn without payment or an obligation to implement it.
8. Ending an account
You may stop using EyesOn at any time and initiate account deletion through the app where available. Deletion removes your account and associated member content from the active service, subject to temporary recovery copies, limited safety or security records, and legal requirements described in the Privacy Policy.
We may suspend or terminate access as described in section 5.
9. Consumer rights and responsibility
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
To the extent permitted by law, EyesOn is provided on an “as available” basis. We are not responsible for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by conduct outside our reasonable control. This does not limit responsibility that cannot lawfully be limited, including responsibility for fraud, wilful misconduct or failure to exercise due care and skill where applicable.
10. Changes
We may update EyesOn or these Terms. We will take reasonable steps to notify you of material changes to the Terms and may require you to accept them before continuing to use EyesOn. Urgent legal, security or safety changes may take effect sooner. If you do not accept a material change, you may stop using EyesOn and close your account.
The current version and effective date will be published with these Terms.
11. Disputes, governing law and contact
If you have a concern, contact us at luke@davolisoftware.com so we can try to resolve it in good faith.
These Terms are governed by the laws of Victoria, Australia. Subject to any right you have to use another court, tribunal or complaint process, disputes may be brought before the courts of Victoria.
